By placing an order on PCS, you represent that you are the age of majority in your state or province of residence, or that you are of legal age in your state or province of residence and that you have given us consent for any minors in your care to use this website and you accept these terms and conditions which apply to all products on the site.

PCS may, at any time, change, in whole or in part, the terms and conditions mentioned herein. The customer may not use our products for illegal or unauthorized purposes, nor may he change the content of the service or send messages that contain computer viruses, or that may cause any other damage.

PRODUCTS


The products found on www.plasticsolutions.pt may have limited quantities and are subject to exchanges and returns in accordance with the conditions set out below.

We have done our best to display the colors and images of the products in the store as accurately as possible. We cannot guarantee that the display of any color on your computer monitor will be accurate. The non-availability of a product in the online store does not mean that a product is out of stock, and may be available through another brand distribution channel.

All product descriptions or product prices are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

PRICES


The prices of our products are shown in Euros and are subject to change without notice.

The prices shown include VAT at the legal rate in force at the time of purchase, plus the respective shipping costs.

The price of the products, the value of VAT and the cost of shipping are duly detailed before the final validation phase of the purchase. Any other costs resulting from sending orders abroad, namely customs clearance costs, will be the sole responsibility of the purchaser of the product.

The order of the products is made by placing them in the shopping cart, filling in the data for invoicing and shipping, and finalizing the order using the available payment methods. It is the customer's responsibility to ensure that the data provided is correct, complete and up to date.

The data to be provided may be personal data necessary for the fulfillment of legal and contractual obligations (among which issuance of invoicing and dispatch of orders), which will be processed in legal terms.

The amount to be paid will be the total sum of the price of the good, including fees and taxes, and the transport charges, postage or shipping or delivery charges and other fees when applicable.

PCS Solutions reserves the right to refuse any order, regardless of the reason, and is exempt from liability for any damages or costs, as well as reserves the right to cancel any purchase even if it has already been accepted or confirmed, namely by following reasons:

i. The information provided is not correct or verifiable;

ii. The order is flagged by the platform's Security Systems as an incorrect, irregular order, or an order susceptible to fraud;

iii. When the transfer/effective payment of the order is not received within a period of 5 working days following the acceptance of your order;

iv. When it is not possible to deliver the order to the address provided;

v. If it turns out that there was an error on the page, such as miscalculations, prices or stocks.

The data contained in the invoice is the sole responsibility of the Customer. Once issued, the invoice cannot be reissued with changes.

In case of non-payment within two working days following the order, it will not be followed up.

DELIVERY POLICY

There are delivery fees that will be displayed during the ordering process. In mainland Portugal, orders are usually delivered within 1 to 3 business days. In the European Union, the delivery time can vary between 5 to 15 working days. Deliveries to the rest of Europe and other countries vary by destination, shipping time and customs processing; however, delivery is estimated between 8 to 20 business days.

Deliveries made outside European Union countries – the import tax, or sales tax, applicable in your country will be paid by the customer to the carrier upon delivery.

PCS sends orders from Monday to Friday. Saturdays, Sundays and holidays are not shipped.

ATTENTION

PCS is not responsible for a delay in shipment caused by weather conditions or any other circumstances beyond PCS' control.

FREE RESOLUTION OF THE CONTRACT

The customer has the right to freely terminate the purchase and sale contract carried out through PCS – Plastic Solutions (www.plasticsolutions.pt.), without indicating the reason, to be exercised by means of an unequivocal declaration of termination of the contract to be communicated within the deadline. 14 days from:

i.) the day on which the customer or a third party, with the exception of the carrier, indicated by the customer acquires physical possession of the goods, in the case of purchase and sale contracts, or:

ii.) the day on which the customer or a third party, with the exception of the carrier, indicated by the customer acquires physical possession of the last good, in the case of several goods ordered by the customer in a single order and delivered separately,

iii.) the day on which the customer or a third party, with the exception of the carrier, indicated by the customer acquires physical possession of the last batch or element, in the case of delivery of a good consisting of several batches or elements,

iiii.) the day on which the customer or a third party indicated by him, other than the carrier, acquires physical possession of the first good, in the case of contracts for the periodic delivery of goods during a certain period.

Without prejudice to the right to inspect, with due care, the nature, characteristics and functioning of the property, in order to return the property(s) under the right of free resolution, the following conditions must be observed:

i. The returned item must be intact, with no damage or signs of use.

ii. Items must always be returned together with their original packaging, manuals and any other accessories belonging to them, which must be in perfect condition.

iii. Items must be accompanied with a copy of the invoice.

The costs of returning the good(s) are borne by the Customer, the supplier not bearing any costs inherent to such return, unless the reason for the return is attributable to the supplier.

The customer must return the good(s) within 14 days from the date on which he has communicated his decision to terminate the contract under the legal terms, the supplier of the good reserving the right not to accept goods that do not meet the return conditions.

The refund will be made in accordance with the law.

Products that have been exchanged previously cannot be exchanged.

If the reason for the exchange or return is attributed to PCS, the company will be responsible for the return costs.

GUARANTEES

In case of lack of conformity of the good with the contract, the customer who is a consumer, that is, to whom goods are supplied for non-professional use, is entitled to have the conformity restored free of charge, by means of repair or replacement. , an appropriate reduction in the price or termination of the contract within the warranty period of two years from the delivery of the goods, unless there is an agreement to reduce the period to one year in the case of sale of used goods.

In the event of non-compliance of the good with the contract, the customer who is not a consumer, that is, to whom goods intended for professional use are supplied, may exercise the rights provided for by law.

The following are excluded from warranty:

i. Misuse or abusive use.

ii. Damage caused by lack of protection.

iii. Normal wear of materials.

iv. accidents.

A breach of warranty is understood in the following cases:

i. Original equipment alteration, including nameplate removal.

ii. Equipment operated by third parties.

iii. Equipment that has undergone repair attempts by third parties.

The existence of a defect or lack of conformity of the good must be recognized by the technical services of PCS – Plastic Solutions

In case of defect or lack of conformity, the consumer customer must notify PCS – Plastic Solutions within two months from the date on which the defect or lack of conformity was detected.

PCS – Plastic Solutions is not responsible for the consequences of inoperability of the equipment where the component to be repaired or replaced under warranty is integrated, nor does it assume the responsibility that may eventually occur to the Customer for the lack of this equipment, namely breakdowns in its production, penalties that are attributed to it for delays or any other reasons resulting from the lack of equipment during repair or replacement under warranty, with the exception of the provisions of the law.

CLAIMS

The Customer may submit its complaints to aPCS – Plastic Solutions in writing via email (geral@plasticsolutions.pt) or regular mail.

INTELLECTUAL PROPERTY

All content on this page is the intellectual property of Moldes Catarino, Lda or authorized use by its business partners, and cannot be copied or reproduced, except to the extent strictly necessary to allow its online reading.

FORCE MAJEURE

PCS – Plastic Solutions will make all reasonable efforts to fulfill its obligations, however it cannot be held responsible for delays, non-delivery of goods or other cases motivated by circumstances beyond its control. Such circumstances include strikes, pandemics, wars, natural or other catastrophes, which make it impossible to produce, transport or deliver products.

APPLICABLE LAW AND COMPETENT JURISDICTION

These General Sales Conditions are governed by Portuguese law and the parties agree to submit to the exclusive jurisdiction of the Portuguese Courts.

ALTERNATIVE CONSUMER DISPUTES RESOLUTION

In the event of a consumer dispute, the consumer can use the European Platform for Online Dispute Resolution, available at http://ec.europa.eu/consumers/odrou in the national territory to the various entities for the alternative resolution of consumer disputes, of which we suggest the CNIACC – National Center for Information and Arbitration of Consumer Conflicts; tel: 213 847 484; e-mail: cniacc@unl.pt, or the Consumer Conflict Arbitration Center corresponding to the consumer's domicile.
